General Terms and Conditions Just the Jacket (www.justthejacket.com)
These are the general terms and conditions of Just the Jacket. Just the Jacket is located in ’s-Hertogenbosch and registered with the Dutch Chamber of Commerce under number 82624151.
1. Definitions
In these general terms and conditions, the following definitions apply:
- Just the Jacket/we/us: the user of these terms and conditions, i.e., the party with whom you place your order.
- You/your: the customer entering into an agreement with Just the Jacket.
- Agreement: any agreement between Just the Jacket and you.
- In writing: communication by post, email, or other communication services.
2. Applicability of these terms and conditions
2.1. These general terms and conditions apply to all agreements between Just the Jacket and you as a customer.
2.2. Deviations from these terms and conditions are only valid if both you and Just the Jacket have confirmed them in writing.
2.3. If you use your own terms and conditions, these are expressly rejected and are not applicable.
3. Offer and conclusion of the agreement
3.1. As a customer, you can view our offer on our website. By placing an order in the webshop, you agree to this offer. You will receive an order confirmation by email. At that moment, an agreement is concluded.
3.2. Just the Jacket cannot be bound by an offer if it contains an obvious mistake or typo. In such cases, we will inform you as soon as possible, and no agreement is concluded.
3.3. We point out that the actual colors of products may differ from what is shown on your screen.
3.4. All terms mentioned are indicative and are never strict deadlines.
3.5. Just the Jacket targets adults. If you are a minor, we assume that you have parental or guardian consent to place the order.
4. Price and payment
4.1. Prices on the website include 21% VAT.
4.2. Shipping costs are not included and are charged separately. Shipping costs are calculated in the shopping cart before completing your purchase.
4.3. Purchases must be paid immediately unless otherwise agreed.
4.4. All products are delivered under retention of title. Ownership remains with us until all outstanding invoices are fully paid.
4.5. You are not entitled to offset or suspend payment.
4.6. If you are allowed to pay afterwards and do not pay within the agreed term, we will charge statutory interest and collection costs.
4.7. If you use a discount code incorrectly, you must pay the full price plus €25 administrative costs.
5. Execution of the agreement
5.1. Because embroidered orders are handmade, the placement of the embroidery cannot always be guaranteed in exactly the same position.
5.2. We will exercise the utmost care in executing the agreement.
5.3. If we cannot deliver the product you ordered, we will inform you as soon as possible. The agreement will then be canceled, and you will receive a refund.
5.4. The delivery time indicated on the website is always indicative. If you need the order on a specific date, it is your responsibility to contact us before concluding the agreement.
6. Shipping and transfer of risk
6.1. We offer standard shipping methods. After delivery to the specified address, the risk passes to you.
6.2. If you choose a different delivery service, the risk passes when we hand over the order to that service. If you collect the order yourself, the risk passes when you take possession of the products.
6.3. In the case of resale by a reseller (B2B), the risk passes when the reseller takes possession of the products. Any decrease in value during this period is charged to the reseller.
7. Use of products
7.1. Products comply with reasonable requirements of quality and usability for normal use, meaning personal use, not business purposes.
7.2. Claims are excluded for damage due to intent or negligence, normal wear and tear, or improper use.
7.3. If products are defective upon receipt, you must report it as soon as possible, take photos, and notify us within two months.
8. Gift cards
8.1. Gift cards can be issued digitally or physically.
8.2. Gift cards are valid until the date indicated or two years after issuance.
8.3. Gift cards cannot be exchanged for cash. If a purchase is paid with a gift card and returned, the amount is refunded to the gift card.
8.4. You are responsible for keeping the gift card and code safe. We do not store a copy. Loss or theft is at your own risk.
9. Liability
9.1. Our liability is limited to what is stated in this article.
9.2. We are only liable for direct damage. Indirect or consequential damage (e.g., lost savings, lost profit) is excluded.
9.3. Liability is limited to the value of the agreement, max €500, unless our insurance covers more.
9.4. A claim arises only after you have given us a reasonable period to remedy the situation.
9.5. Just the Jacket is not liable for differences in color or embroidery placement from your expectations.
9.6. The limitations of liability do not apply in cases of intent or deliberate recklessness.
10. Right of withdrawal
10.1. Applies only to natural persons acting outside professional/business activities.
10.2. Custom-made products are excluded from the right of withdrawal.
10.3. You may cancel the agreement within 14 days after receipt.
10.4. The 14-day period starts when you or a designated third party receives the order. For multiple deliveries, it starts when the last item is received.
10.5. Products must be handled carefully during this period. You may unpack or use them only as necessary to assess the nature and characteristics.
10.6. You are liable for any reduction in value due to improper use.
10.7. To exercise the right of withdrawal, send an email to customerservice@justthejacket.com with explicit notice.
10.8. Return the products within 14 days, in their original state and packaging.
10.9. Refunds will be made within 14 days using the original payment method. We may wait until we have received the products or you provide proof of return.
10.10. If you chose a different shipping method, only standard shipping costs are refunded.
10.11. The risk and burden of proof for timely and correct withdrawal lies with you.
10.12. You pay the costs of return shipping.
11. Intellectual property
11.1. All designs of Just the Jacket are our intellectual property. Purchasing does not grant rights.
11.2. You may not copy or reproduce our designs.
12. Force majeure
12.1. If obligations cannot be fulfilled due to force majeure, performance is suspended.
12.2. Examples: illness, supplier delays, fire, water damage, flood, strikes, government measures, pandemics, riots.
12.3. If force majeure lasts longer than a month, either party may terminate the agreement. Executed parts remain payable.
13. Complaints
13.1. Send complaints in writing to customerservice@justthejacket.com. We will seek a solution together.
13.2. Consumers can also submit a complaint via the European online dispute resolution platform: https://consumer-redress.ec.europa.eu/index_en
14. Final provisions
14.1. Dutch law applies. The Vienna Sales Convention is excluded.
14.2. Disputes are submitted to the competent Dutch court in Oost-Brabant, unless mandatory law dictates otherwise.
14.3. If any provision is invalid, the rest remains valid. A replacement clause will be drafted reflecting the original intent.
